This Privacy Notice for Eversummer Studio (“we,” “us,” or “our”) describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use our services (“Services”), including when you:

  • Download and use our mobile application PlantSimple, or any other application of ours that links to this Privacy Notice; and
  • Engage with us in other related ways, including any sales, marketing, or events.

Questions or concerns? Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed. If you do not agree with our policies and practices, please do not use our Services.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Sensitive Information. We do not process sensitive information.

Application Data (including iCloud / CloudKit Sync & Sharing)

If you use our application(s), we may process the following information if you choose to provide us with access or permission:

  • iCloud/CloudKit Data: PlantSimple uses Apple’s CloudKit to sync your plant records and related data across your devices signed in with your Apple ID. Your data is stored primarily in your private iCloud database and is encrypted in transit and at rest by Apple. We (Eversummer Studio) generally do not have direct access to the contents you store in your private iCloud database.
  • Sharing: If you choose to share certain objects (e.g., specific plants and their related records) with other iCloud users, those users will be able to view and/or edit the shared data according to the permissions you grant. You can revoke sharing at any time through the app or via iCloud controls, and access will be removed for the recipients.
  • Record Metadata: We may receive or log non-content metadata required to operate the app and CloudKit integration (e.g., record IDs, timestamps, sync status) to troubleshoot sync issues and to improve app reliability.
  • Mobile Device Access: We may request access or permission to certain features from your mobile device, including your mobile device’s camera, photo library, notifications, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.
  • Push Notifications: We may request to send you push notifications regarding reminders (e.g., watering/fertilizing) or updates. You can disable push notifications in your device’s settings.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including to:

  • Provide and maintain the PlantSimple app and features, including iCloud sync and sharing functionality via CloudKit.
  • Respond to your inquiries, provide customer support, and troubleshoot issues.
  • Send administrative information to you, such as changes to our terms, conditions, and policies.
  • Protect our Services, our users, and the public against fraud, abuse, or other harmful activity.
  • Comply with legal obligations, resolve disputes, and enforce our agreements.
  • Improve the app experience through aggregated or de-identified analytics (if applicable).
  • With your consent, send you promotional communications (where applicable by law).

To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.

If you are located in the EU or UK:

The GDPR/UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. We may rely on the following legal bases:

  • Consent: You have given us permission (consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.
  • Legal Obligations: We may process your information where necessary for compliance with our legal obligations.
  • Vital Interests: We may process your information to protect your vital interests or those of a third party.

If you are located in Canada:

We may process your information if you have given us specific permission (express consent) or in situations where your permission can be inferred (implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent (e.g., fraud prevention, legal requests, etc.).

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described below.

  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Apple (CloudKit/iCloud): Apple acts as an infrastructure provider for iCloud/CloudKit. Your synced and shared data is stored in your iCloud account governed by Apple’s terms and privacy policy. Apple processes this data on our behalf to provide the sync/sharing functionality. We do not sell your personal information.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice, unless otherwise required by law.

Because most user data is stored in your iCloud account, you can manage and delete such data directly via PlantSimple or your iCloud settings. Where we hold limited metadata/logs for troubleshooting or analytics, we retain it only for as long as needed for the purposes described in this Notice or as required by law. When we have no ongoing legitimate business need to process such information, we will delete or anonymize it.

6. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at [email protected].

7. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your location, you may have certain rights regarding your personal information.

These rights may include the right to request access to and obtain a copy of your personal information, to request rectification or erasure, to restrict the processing of your personal information, to data portability, and (where applicable) to object to processing. If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection authority. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent

If we rely on your consent to process your personal information, you may withdraw your consent at any time by contacting us. This will not affect the lawfulness of the processing before its withdrawal.

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature. As no uniform standard has been finalized, we do not currently respond to DNT signals. If a standard is adopted that we must follow, we will update this Privacy Notice accordingly.

9. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Residents of certain US states may have additional rights.

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you, correct inaccuracies, get a copy of, or delete your personal information, and withdraw your consent to processing. These rights may be limited in some circumstances by applicable law.

We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We do not sell or share personal information.

Request Verification

California “Shine the Light” Law

California Civil Code Section 1798.83 permits California residents to request information regarding disclosures of personal information for direct marketing purposes. We do not disclose personal information to third parties for direct marketing purposes.
